Supreme Court Upholds EPA Refrigerant Allocation Rules Under AIM Act

The Supreme Court has refused to hear challenges to EPA's refrigerant allocation system under the AIM Act, leaving intact the framework that governs how HFC and HFO refrigerants are distributed to contractors and distributors.

The Supreme Court declined to review petitions challenging the Environmental Protection Agency's refrigerant allocation rules established under the American Innovation and Manufacturing (AIM) Act. The decision keeps the current allocation framework in place—the same system that determines how much R-410A, R-32, and newer A2L refrigerants like R-454B flow through the supply chain to your distributors.

HARDI (Heating, Air-conditioning and Refrigerant Distributors International) and PHCC (Plumbing-Heating-Cooling Contractors Association) both filed amicus briefs supporting the EPA's position. Their argument: any disruption to the allocation system would destabilize refrigerant pricing and availability at the contractor level. The industry groups warned that overturning the rules mid-transition could spike costs and create regional shortages, especially as the 2025 residential equipment changeover to A2L refrigerants accelerates.

The AIM Act, passed in 2020, mandates an 85% phasedown of HFC production and consumption by 2036. The EPA's allocation system assigns production and import allowances to chemical manufacturers and reclaimers based on historical baselines. Critics argued the agency overstepped its authority in how it calculated those baselines, but the Court's refusal to hear the case effectively ends that legal challenge.

For contractors, this ruling means predictability. You can plan refrigerant inventory and pricing strategies around a stable regulatory framework through at least 2026. Stock A2L refrigerants—R-454B and R-32—now, as the January 1, 2025 manufacturing cutoff for non-A2L equipment has already passed. If you're still installing R-410A systems, confirm your distributor's allocation and lock in pricing for the next 12 months. Reclaim cylinders are worth more under a constrained supply model; track your returns and claim credit.

The ruling also shuts down one of the last legal avenues for delaying the HFC phasedown. Expect the EPA to continue tightening allowances on schedule. By 2028, R-410A availability will be significantly reduced, and spot prices could exceed $15 per pound in high-demand markets. Contractors who've already transitioned to A2L equipment and obtained EPA 608 certification updates will have a competitive edge in bidding and service work.
